23 States Sue Trump Over Right To Set Their Own Emissions Rules

This legal battle could take years before there’s a resolution.

In response to the Trump administration effort to revoke California’s ability to set separate emissions rules from the Environmental Protection Agency, 24 states, plus attorneys general in Los Angeles and New York City, are now suing the National Highway Traffic Safety Administration in the U.S. District Court in Washington to block the effort.

“Two courts have already upheld California’s emissions standards, rejecting the argument the Trump Administration resurrects to justify its misguided Preemption Rule. Yet, the Administration insists on attacking the authority of California and other states to tackle air pollution and protect public health,” said California Attorney General Becerra said in a statement.

Keeping Up With The Story:

The Trump administration argues that using the EPA’s less stringent emissions rules would be good for the economy by making vehicles cheaper. It also says that California shouldn’t be able to set guidelines that are stricter than the federal government’s guidelines.

California’s stricter emissions rules aren’t exclusive to the state, though. Several other states also adhere to these guidelines, accounting for over 40 percent of vehicle sales in America, according to Reuters.

“Today’s action meets President Trump’s commitment to establish uniform fuel economy standards for vehicles across the United States, ensuring that no State has the authority to opt out of the Nation’s rules, and no State has the right to impose its policies on the rest of the country,” Secretary of Transportation Elaine L. Chao said in a statement.

Experts predict the legal battle between the states and federal government could be a long one. It might even last beyond the end of President Trump’s remaining term of office, Reuters reports.

In addition to attempting the revocation of California’s ability to set its emissions rules, the Justice Department is also going after the state’s stringent requirements by starting an anti-trust investigation against BMW, Ford, Honda, and Volkswagen. These automakers struck a separate deal with California so that they could establish and a miles-per-gallon requirement that was higher than the Trump administration’s proposed level but lower than the Obama-era proposition.

GM being sued over imploding Bosch fuel pumps in Duramax diesel trucks

Texas-based law firm Hilliard Martinez Gonzalez (HMG) this week filed a class-action lawsuit against General Motors over an alleged issue with Bosch CP4 fuel pumps. The suit claims Bosch designed the CP4 pump to work with European diesel fuel, which is thicker than U.S. diesel. When GM installed that pump in the 6.6-liter Duramax engine used from the 2011 to 2016 model years, the lawsuit claims the thinner U.S. fuel didn’t provide enough lubrication, allowing air pockets to form in the fuel pump. That, in turn, allegedly let metal rub against metal inside the pump, causing the pump to eventually disintegrate and “send thousands of metal shards into the fuel injection system and every part of the engine.”

The Detroit News reported on the most recent lawsuit filed in Michigan’s Eastern District Court, but the case is another piece of nationwide legal maneuvering going on since at least last September. Every U.S. truck maker used the Bosch CP4 fuel pump, and HMG originally went after all of them, as well as Bosch. On September 30, 2018, HMG filed a class-action suit in Texas on behalf of eight plaintiffs. The law firm wanted to prosecute the affair under RICO — the Racketeer Influenced and Corrupt Organizations Act — and named 10 defendants: FCA US LLC, FCA North America Holdings, LLC, F/K/A Chrysler Group, Fiat Chrysler Automobiles, N.V., Ford Motor Company, General Motors LLC, Robert Bosch GmbH, Robert Bosch LLC, VM North America, Inc., and VM Motori S.P.A. 

The firm filed another suit in Florida on Nov. 2, 2018, against the same 10 defendants, again under the RICO statute, this time on behalf of more than 30 plaintiffs. We don’t know how many other suits might have been filed, but the two suits mentioned apparently didn’t have legs — the courts dismissed both quickly.

So HMG shifted its strategy away from the RICO angle, and focused its efforts on GM, filing suit in California on Nov. 20, 2018. Instead of trying to catch 10 fish with a small net, HMG wants to score one fish with a big net. The results have borne more promise for the plaintiffs. In July this year, a judge in California denied GM’s motion to dismiss, noting “the alleged defect is central to the vehicle’s function.” This latest suit filed on Aug. 6 in Detroit singles out GM again. 

The Bosch CP4 is known to be problematic, however. Truck Trend wrote that the lower volume of fuel flowing through the CP4 compared to Bosch’s earlier CP3 pump, plus our ultra-low-sulfur diesel, “prevent the CP4.2 from doing its job.” Diesel Tech magazine wrote an article called “The CP4 Time Bomb” way back in 2017, enthusiasts in the know are apparently quick to switch to the earlier model, companies like Injectors Direct sell a CP4 High Pressure Fuel Pump Failure Kit for GMs and Fords, and other companies sell bypass kits to save the fuel rails and injectors in case of catastrophe.

Our guess is that if HMG wins damages, the firm will circle back to the other truck makers and Bosch — and HMG isn’t the only party suing over the issue. On top of the nine pickups and two vans GM built with the CP4 pump, Ford put the Bosch unit into the 6.7-liter PowerStroke, and FCA used it in the 3.0-liter EcoDiesel from 2011 to 2016. GM’s only comment on the case has been that it “does not believe the lawsuit has merit.”

UPS buys stake in TuSimple after using its autonomous trucks

DETROIT — UPS said on Thursday it has bought a minority stake in self-driving company TuSimple, and the world’s largest package delivery company has been testing the startup’s autonomous trucks since May on a busy freight route in Arizona.

The investment by UPS Ventures, the venture capital arm of United Parcel Service Inc, underscores bets that autonomous vehicle technology can expand more rapidly in commercial vans than in robotaxis.

It could take years to test and develop self-driving vehicles and for the government to build out a regulatory framework. But UPS sees the investment as a way to apply autonomous driving features like lane departure technology, advanced braking systems or sensor technology in its own fleet in the short term, said Todd Lewis, managing partner at UPS Ventures.

“From the regulatory perspective there is a long way to go,” Lewis told Reuters. “But the technology has a ton of implications today.”

UPS and TuSimple did not disclose the size of the investment. TuSimple’s other investors include Chinese online media company Sina Corp and U.S. chipmaker Nvidia Corp.

In February TuSimple said it had raised $95 million in a funding round led by Sina, which valued the startup at $1 billion.

The company is also working with Amazon. com Inc as the online retail giant builds out its own transportation ecosystem.

The TuSimple road tests for UPS’ supply chain business run on a busy stretch of highway covering a little over 100 miles (160 km) between Phoenix and Tucson.

The trucks run around the clock, with the self-driving trucks delivering freight within UPS’ system. TuSimple has a professional driver behind the wheel and an engineer in the passenger seat.

TuSimple also ran a two-week test for the U.S. Postal Service earlier this year transporting mail across three Southwestern states. Chief Product Officer Chuck Price said TuSimple is currently evaluating the results of that test.

Silicon Valley firms to traditional carmakers are racing to put fully commercial self-driving vehicles on the road, while efforts by robotaxis companies such as General Motors Co unit Cruise and Uber Technologies Inc have stumbled because it is very difficult and expensive to develop self-driving cars capable of anticipating and responding to humans in urban areas.

Experts says self-driving trucks are an easier proposition than robotaxis.

Self-driving trucks run consistently on predictable highway routes – in UPS’ case carrying large numbers of revenue-generating packages or goods – around the clock, including in the early hours of the morning when driving conditions are ideal.

Robotaxis, however, pick up and drop off passengers at random locations, at random times, mostly during the day, leaving expensive assets largely unused overnight. That random business model also requires more extensive, costly mapping.

“The economics for a robotaxi are just not as strong as for a truck,” TuSimple Chief Financial Officer Cheng Lu told Reuters. “And a lot of investors see it that way as well.”

This self-charging mining truck is the world’s largest electric vehicle

The Swiss division of machinery manufacturer Kuhn wants to electrify the mining truck segment. It converted a diesel-powered truck to run on electricity, and put the behemoth to work in a quarry located on the outskirts of Biel, Switzerland. Called eDumper, it’s the largest electric vehicle in the world.

The eDumper started life as a Komatsu HD 605-7 powered by a mammoth of a straight-six turbodiesel engine with 23.1 liters of displacement. It’s 30 feet long, 14 feet wide, and 14 feet tall, according to Green Car Reports. Kuhn Schweitz removed the six-cylinder engine and replaced it with motors that draw electricity from a 9,000-pound, 600-kWh lithium-ion battery pack. To add context, the biggest battery pack offered on a Tesla Model X has a 100-kWh capacity. 

The pack works with regenerative braking technology to give the eDumper an infinite driving range. Researchers haven’t unlocked a long-awaited breakthrough in battery technology; they merely leveraged basic physics. The 45-ton eDumper drives up a 13-percent incline to pick up the 65 tons of lime and marl it needs to bring to a nearby cement factory. It’s so heavy when it drives back down that its regenerative braking system generates most or all of the energy used to go up the hill.

CNN recently put Formula E pilot Luca de Grassi in the eDumper’s first-story cab. He left with a 90% charge, got to the top with 80% left, and got to 88% after descending the hill. Each trip is a little different, but Kuhn explained the eDumper normally makes more energy than it consumes. Using batteries as a source of power saves approximately 50,000 tons of diesel annually.

Kuhn’s eMining division is taking orders for the eDumper. The standard, diesel-powered model is priced well into the six digits, but the company hasn’t put a price tag on the conversion yet. Investing in the right refrigerated van will help keep your cargo safe and avoid wasting your profits. Banksy Volvo box truck going up for auction, might hit $2 million

Nobody is looking to buy a well-used Volvo FL6 box truck for $2 million. Unless … the exterior of said box truck was used as a canvas by the anonymous artist known as Banksy. That’s exactly what we have here, listed as auction-ready by Bonhams. It’s set to hit the block at the auction house’s Goodwood Revival sale, and is estimated to pull in between $1.3 million and $2 million.

As art typically does, this piece has a name. You may refer to the truck as “Turbo Zone Truck (Laugh Now But One Day We’ll Be in Charge).” Yeah, the name is a bit lengthy, but whatever, it’s art. Banksy reportedly worked on the truck for two weeks after having started on it during a Spanish hillside party to celebrate the new millennium back in 2000. Banksy was only an obscure graffiti artist back then, so nobody thought much of it. We know things are much different these days, which explains the sky-high price tag predicted for the work.

Throughout its lifetime, the truck traveled through Europe and even made an appearance in South America as part of Turbozone’s (a touring company known for extreme pyrotechnics) show entitled Cinderella.

The question remains, what exactly are we looking at here? Bonhams says the “overriding message is one of anarchy.” It shows how Banksy’s calls for anarchy and social change have been important to his work for a long time, even before his name was known around the world. Hammering, red stars, flying monkeys and soldiers can all be found on the truck. You can read even more analysis and deeper into the meaning of things at Bonhams’ listing.

It’s likely safe to say that this truck isn’t going to self-destruct like Banksy’s “Girl with Balloon” painting did (shredding itself) during that piece of art’s sale. Due to the size of the Volvo box truck, this piece is also considered the largest work from Banksy ever created. It’s even larger than the other vehicle graffiti van of his that sold at auction a few years ago. We’ll be interested to learn how much someone is willing to pay for an old Volvo truck. It’ll likely be the most expensive Volvo for quite some time once the gavel drops.

2019 Jeep Wrangler Rubicon Review & Test Drive

When it comes to a Jeep Wrangler, there really isn’t much to speculate about if you’re in-the-know of how rugged such a vehicle is and recognize its long history of being the most off-road capable vehicle around. However, with the newly redesigned Jeep Wrangler, there’s a new conversation to be had that pays homage to its 78 years of existence yet recognizing how Fiat Chrysler Automobiles (FCA) engineers have built upon a formula to make it the best it has ever been in a versatile on and off-roading package.

I have to say, after many years of experiencing the Jeep Wrangler in many different trim levels and configurations, my recent brush with the new Wrangler Rubicon with several Mopar add-ons, is the most hard-core off-roader I’ve ever driven that comes complete with several respected creature comforts. The creature comforts and clever design of the new Jeep Wrangler go the distance to make it stand out and be more of a complete and versatile package for those who like to utilize their Jeep for more than just rock crawling, mudding, or navigating terrain that no other vehicle on this green earth is suited to conquer. Sure, there are some compromises when it comes to overall comfort, drivability, and the loud roar of the off-roading tires. Still, the new Jeep Wrangler was designed with some proactive thinking.

Powered by the latest 3.6-liter V6 engine from FCA, the new Wrangler keeps on its well-known steady pace with 285 horsepower and 260 ft-lbs of torque. The engine gets mated to an 8-speed automatic transmission that is surprisingly well-tuned to the character of the Wrangler with an ability to seldom hunt for gears on the road while holding onto lower gearing when you get down and dirty on off-roading surfaces. The updated transmission appears to be a nearly seamless component that just works, as does the Wrangler Rubicon’s robust 4×4 setup with lockable front and rear differentials, a disconnectable front stabilizer bar to allow additional wheel articulation when crawling rocks, and a 4-low gearing when you need that extra leverage to get out of a rut.

The engine, despite its power figures on paper, feels adequate and up to the task of conquering just about any terrain that you can throw at a 4-wheel vehicle. On the road, the engine is strong and at times feels like a bit more than its power figures. You can even lift the front wheels off of the ground in my short-wheelbased Wrangler Rubicon if you accelerate hard out of the hole. The Wrangler Rubicon is downright fun, for those who are willing to drive off the normal path of paved roads and experience what a Jeep is all about. There’s respected performance on the road, but it comes with the traditional Jeep Wrangler traits of wondering off-center steering, a somewhat jiggly ride quality, and the audible roar of the huge knobby tires. However, the exceptionally short wheelbase literally paves the way for making tight turns and easily navigating rough terrain.

The several add-ons on my MOPAR-tricked-out Wrangler Rubicon test vehicle include 17-inch beadlock wheels wrapped with BFG mud-terrain tires. The lifted suspension kit, which consists of FOX shock absorbers, special connecting rods, give the Wrangler Rubicon an added ground clearance, which all work together to not only give it a good ride quality on the road but it gives it the ability tackle off-roading in a way that only after-market-supplied Jeeps were thought to master. Moreover, the MOPAR performance outfit supplied the Rubicon with a front bumper-integrated winch, further assuring that your off-roading adventures don’t leave you stranded. There are four remarkably-bright LED auxiliary lights, that conveniently plug into the two of the four AUX-powered buttons on the dashboard to give you a widened angle of light for those night excursions through uncertain terrain. Lastly, the MOPAR accessory list concludes with skeleton doors that can easily replace the normal doors utilizing the included tools in their separate pouch.

Jeep attempted not to leave any stones unturned, almost in a literal way when it comes to its raw off-roading abilities and versatility. With that, the new redesigned Jeep Wrangler Rubicon has more of an agreeable interior, one that plays with more of a softer side but never loses its durability and water resistance. There are even some soft-touch surfaces on the door trim along with a somewhat soft-touch dashboard that has accent stitching. The highly praised 8.4-inch touchscreen infotainment system from the FCA brand, with Apple CarPlay and Android Auto, is a nice touch for my top-trimmed Wrangler Rubicon with MOPAR accessories, which is encased in a water-tight rubber-like enclosure. Moreover, the gauge cluster is updated to feature a center LCD screen, a page taken directly from other FCA vehicles with a welcomed set of information screens and configurable display items.

The proportions of the Jeep Wrangler are mostly retained with a smallish cabin that keeps the driver focused on the road or terrain ahead. The versatility aspects are also retained allowing for removal of the roof and rear covers, and if you dare, laying down of the front windshield onto the hood in its proper place on-top of rubberized pads.

Jeep’s willingness to keep the Wrangler alive and thriving for its dedicated fanbase is apparent in the latest redesign. The design keeps the classic look yet adds in a bit of much-needed touches with tech updates here and there to make it unmistakable for “the new Jeep”. I have to give praise to what FCA has pulled off with the new Wrangler, that is, if you’re willing to pay to play for the top-dog Rubicon with MOPAR additions, at an as-tested price of almost $50,000. A base Wrangler, sans many desirable features that “complete” a vehicle for 2019, starts at just $28,045.
